These Terms of Service ("Terms") govern your access to and use of Fueling Optimizer (the "Service").
By using the Service, you agree to these Terms.
If you do not agree, do not use the Service.

## 2. Service Description

Fueling Optimizer provides deterministic, rule-based fueling recommendations for athletic training sessions.
The Service is for informational purposes only.

## 3. No Medical Advice

The Service does not provide medical advice, diagnosis, or treatment.
Recommendations are general and may not fit your individual health condition.
Consult a qualified healthcare professional before making nutrition or hydration decisions, especially if you have medical conditions.

## 4. Eligibility and Accounts

You must be legally able to enter into binding contracts under applicable law.
You are responsible for:

- providing accurate registration information;
- maintaining the confidentiality of your account credentials;
- all activity under your account.

You must notify us promptly of unauthorized account use.

## 5. Acceptable Use

You agree not to:

- violate applicable laws or regulations;
- misuse, disrupt, reverse engineer, or attempt unauthorized access to the Service;
- upload harmful content or code;
- use the Service to infringe third-party rights.

## 6. Intellectual Property

All rights, title, and interest in the Service (excluding user-provided content) remain with Fueling Optimizer and its licensors.
These Terms grant you a limited, non-exclusive, revocable right to use the Service.

Continued use after updates means you accept the revised Terms.

## 9. Disclaimer of Warranties

We do not guarantee uninterrupted, error-free, or fitness-for-purpose operation.

To the maximum extent permitted by law, Fueling Optimizer and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or business opportunity, arising from use of the Service.
Our total liability for any claim related to the Service will not exceed the amount you paid us for the Service in the 12 months preceding the claim (or EUR 0 if no fees were paid).

## 11. Indemnification

You agree to indemnify and hold harmless Fueling Optimizer from claims, damages, and expenses arising from your misuse of the Service or violation of these Terms.

## 12. Termination

We may suspend or terminate access if you violate these Terms or if required for security, legal, or operational reasons.
You may stop using the Service at any time.

## 13. Governing Law and Venue

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law principles. Exclusive venue for disputes is the place of residence of the service operator in Germany, unless mandatory consumer law provides
otherwise.
